Licence for Alterations (Tenant Approval)
Fitzpatrick Property Consultants act for landlords in considering tenants
proposed alterations; fit-out or shop-fit works, whilst we are also appointed by
tenants in order to obtain landlords consent for their proposed works.
Tenants' proposals are usually legally documented by way of a formal 'licence
for alterations' although minor tenant works may be approved by way of a 'letter
of consent'. The lease agreement may also comment on alterations for example
that non structural alterations do not require express landlords consent.
When acting for landlords, we consider the undernoted to ensure there are no
conflicts with the building fabric / landlord installations and to mitigate the
risk of impact to the quiet and peaceful enjoyment of the premises by other
tenants:-
- Statutory consents
- Notification to building insurers and fire authority
- Sprinkler installations (mainly in respect of shopping centres)
- CDM Regulations / Planning Supervision issues
- Other legislative compliance
- Tenants fitting out handbook
- Proposed programme
- Tenant design team
- Contractor insurances
- Site administration
- Nature and detail of the actual works, ensuring liaison with landlord /
site staff
- Monitoring the works on site, ensuring compliance with 'approved'
proposals
- Commissioning and statutory sigh-off
- Collation of As Built record documents and issuing of Health & Safety
File
We also act for tenants in obtaining landlords consent, in order to mitigate
the risk of delays to their overall programme, which may manifest itself in a
deferred signing of the lease; start and completion dates of any building works.
Any delays to trading or occupying premises could create business logistical and
continuity issues.
